Branch or Representative Offices in Thailand
The Thai government grants certain tax advantages to offices set up in Thailand by foreign companies. Such offices are, for the most part, restricted in the functions they may perform, and in most cases cannot generate income by selling goods or services in the country. They can however provide special services of benefit to their home offices, including:
- Marketing of the company's products in Thailand, including giving advice to Thai customers and providing them information on new products;
- Sourcing goods in Thailand destined for the head office;
- Checking and controlling the quality of goods sourced in Thailand for the head office;
- Reporting Thai and regional business trends to the head office.
Regional Operating Headquarters
A further category of office—the Regional Operating Headquarters—was recently defined and granted special tax advantages by the Thai government. Such offices are set up by international firms to oversee operations of a number of the company’s branches in Asia.
Setting up Branch Offices and Regional Operating Headquarters
EUROPEAN LAW ASSOCIATES will assist its foreign clients in setting up such offices in Thailand, by preparing all required documentation from the Head Office and submitting the application to the Foreign Business Department of the Thai Ministry of Commerce. EUROPEAN LAW ASSOCIATES will also represent the client during the deliberations at the Foreign Business Department, leading to issuance of the Foreign Business license in about 60-90 days
Once operations have begun, EUROPEAN LAW ASSOCIATES will guide the client in preparing the periodic reports required by the THAI government.
Branch and Representative Offices are granted licenses to operate for a period ranging from 3-5 years, renewable.
